These Terms of service (“Terms”) govern your use of the honyaku.dev Service and form a binding agreement between you (“Member” or “you”) and honyaku.dev. (“we”, “us”, “honyaku.dev”).

1. Introduction

honyaku.dev is a web service available at honyaku.dev that allows users to upload, manage, and translate texts for mobile, desktop, and web applications (“Apps”). The Service is owned and operated by honyaku.dev.

2. Eligibility

To use the Service, you must:

  • Complete the registration process
  • Agree to these Terms
  • Agree to the Privacy Policy and Data Processing Agreement
  • Provide a true, complete, and up-to-date email address

By using the Service you represent and warrant you meet these requirements and will comply with all applicable laws.

3. Account & Password

You are responsible for keeping your account credentials safe and for all actions taken under your account.

4. Hardware/Software Requirements

Access to the Service requires a modern internet browser (e.g., Chrome, Firefox, Safari, Edge).

5. Plans and Payments

  • Fees and pricing are posted on the website and may change.
  • Alternative fees may be offered at honyaku.dev’s discretion.
  • Supported payment methods include credit and debit cards (via Stripe).
  • Recurring payments may be enabled or terminated as desired.
  • Service may be restricted or suspended for non-payment.

6. Additional Services

honyaku.dev may provide extra services (such as customizations or content processing) at a charge and at its discretion.

7. Refunds

You may request a refund when:

  • You are charged twice for the same service.
  • You are unable to use the service due to technical issues lasting more than 3 days.

8. Changes of Pricing

honyaku.dev may change its pricing structure at any time, applying changes to all Members.

9. Proprietary Rights

You agree to respect honyaku.dev’s software and Service IP. Reverse engineering or misuse can lead to account suspension and retention of payments.

10. Misuse of the Service

Any attempt to bypass, manipulate, or avoid usage calculations, quotas, or rules of the Service may result in termination of your account and retention of payments.

11. Privacy

By signing up, you also agree to the Privacy Policy.

12. License Grant

You represent you own or have permission to use all texts and translations submitted to the Service (“Translations”). You grant honyaku.dev an irrevocable, non-exclusive, worldwide, royalty-free license to use and share Translations as required to provide Services to you and other Members. This license survives termination.

13. General Rules

You agree to use the Service in good faith and not for harmful, illegal, or abusive content. Misuse may result in account suspension.

14. Compliance with Laws

You must comply with all applicable laws, including those related to data protection and regulated use cases. honyaku.dev is not liable for compliance if the Service is unsuitable for regulated environments (e.g., HIPAA).

15. Limitation of Liability

To the maximum extent permitted by law:

  • You assume responsibility for loss
  • honyaku.dev is not liable for indirect, special, or consequential damages
  • Total liability is capped at what you paid in the previous year

16. No Warranties

The Service and all components are provided as-is with no warranties, express or implied.

17. Disclaimers

honyaku.dev is not responsible for third-party providers, partners, linked sites, or other Members.

18. Termination

Either party may terminate this agreement at any time with written notice.

19. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service, including their formation, performance, or termination, shall be finally resolved by binding arbitration.

The arbitration shall be conducted in English and administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The place of arbitration shall be the United States, unless otherwise agreed by the parties.

Judgment on the arbitral award may be entered in any court of competent jurisdiction.

Nothing in this section shall prevent honyaku.dev from seeking injunctive or equitable relief in any competent court for the protection of its intellectual property or confidential information.
